General

This Application form sets out and collects pertinent information about the Call for Innovators program (the “Program”). This enables WRCC to assess the merits of the proposed Application and its fit with the goals of the Program. The Applicant must complete the Application in its entirety. Applicants who fail to complete all sections may not be considered.

It is essential that you read and understand the Program Guide before completing this Application. All capitalized words or terms that are not defined within this Application have the respective meanings set out in the Program Guide. In this Application, the term “you” and “Applicant” are used interchangeably.

In addition, this Application form includes terms and conditions governing the Application process and the Program. Please read this document carefully. By submitting an Application, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, you may not participate in the Program.

To complete this Application, answer all questions on the form. If you require assistance in completing your Application or have any questions about the Call for Innovators program, please email innovation@wrcc-crffc.com.

The complete contents of your Application will be reviewed by experts to decide if it will be selected. At no time will WRCC disclose information about the reviewers to the Applicant, and the Applicant is not entitled to access or review the experts’ decision.

WRCC will use reasonable efforts to inform the Applicant about its decision in a timely fashion. Any delay or failure to inform the Applicant of the decision will not result in any obligation or liability of WRCC to the Applicant or any other interested party.

WRCC has sole and unfettered discretion over its funding decisions, including but not limited to the decision to fund or not fund, or the amount, timing, and terms attached to such funding. If your Application is selected by WRCC, you will be required to enter into an agreement with WRCC as a condition of receiving the funding and participating in the testing phase of the Program.

All of WRCC’s decisions, including but not limited to the decision to fund or not fund, are final, binding on the Applicant, and non-appealable. WRCC is not an administrative agency, commission, or tribunal, and as such, the Applicant is precluded from seeking judicial review of any of WRCC’s decisions arising from its evaluation of this Application. WRCC receives a large volume of Applications. The chances of your Application being selected depend upon the number and calibre (based upon the evaluation criteria) of completed Applications that are received by WRCC. WRCC may decline to evaluate the Application at any time for any reason. WRCC also has the right, as determined in its sole and absolute discretion, to impose a lifetime limit on the number of Applications an Applicant may submit.

WRCC will provide copies of the Application, including any attachments, only to the Applicant Representative. Accordingly, any change of the Applicant Representative should be to an individual who has the authority and permission to see the Application and any attachments.

The Application process, the Program, and these terms and conditions are governed by the laws of the Province of British Columbia. WRCC may perform its obligations hereunder through its agents, suppliers or subcontractors. WRCC’s failure to insist upon or enforce strict performance of any right or provision these terms and conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained herein are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein.

Access to Information

WRCC could be compelled to disclose the information received in your Application, or other information delivered by you to WRCC in relation to the Program, if and when its funding providers audit WRCC or exercise inspection or other rights under their funding agreements with WRCC. Such funding providers, in turn, may be subject to access to information legislation that may allow members of the public to access the information that the funding providers have accessed or received.

WRCC encourages all Applicants not to include any commercially-sensitive information in their Applications, since WRCC cannot guarantee that such information will be kept confidential.

Verification

An Application may be subject to verification at any time and for any reason. WRCC reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to WRCC): (a) for the purposes of verifying the eligibility and/or legitimacy of any Application and/or other information submitted for the purposes of the Program; and/or (b) for any other reason WRCC deems necessary, in its sole and absolute discretion, for the purposes of administering the Program. Failure to provide such proof to the complete satisfaction of WRCC within the timeline specified by WRCC may result in disqualification in the sole and absolute discretion of WRCC.

Publication of Non-Confidential and Aggregate Information by WRCC

WRCC is authorized to make public certain details contained in your Application, including the name of the Applicant, the name of the Innovation, and a brief description of the Innovation (the “Public Materials”). The Applicant grants to WRCC a perpetual, worldwide, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, create derivative works from, publish, translate, license, transmit, distribute and otherwise exploit the Public Materials in any manner or media and by any means of technology now known or hereafter developed. In addition, the Applicant confirms that the content of the Public Materials is wholly original and that WRCC is free to use the Public Materials as aforesaid.

In addition, the Applicant’s and the Applicant Representative’s contact information are subject to disclosure by WRCC in its sole discretion at any time. Also, WRCC may aggregate information within your Application for the purposes of reporting or dissemination in the public domain. For clarity, “aggregate” means removing personal identifiers such as names, locations, and addresses of the Applicant and employees, and combining such information with that of other Applicants.

Limitation of Liability

The Applicant agrees WRCC and its agents, suppliers and subcontractors shall not, to the maximum extent permitted by applicable law, be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, the Applicant’s submission of an Application or participation in the Program, including without limitation the failure of the Program or the Application process to meet the Applicant’s needs or expectations.

Consider the value proposition for wildfire agencies, customers, early adopters, and other end-users (e.g., saves time; better quality; easier to use; more convenient; minimizes risk; reduces pain; highly credible; socially responsible; saves money; etc.). WRCC requests your permission to share information contained in this application with our trusted third parties, for the following purposes: WRCC receives public and private fundings that require it to report on key performance indicators, deliverables, and outcomes achieved through its grants funding. To maximize the impacts of this Program, WRCC also collaborates with its trusted third parties to execute this Program and Pilot Projects.
